What changed

The OCC issued stablecoin application and waiver guidance on October 21, 2026. Existing U.S. issuers need substantially complete applications pending by January 18, 2027 to request transition waivers. The OCC generally expects to grant qualifying requests concerning prior approval, subject to individual review. The OCC has not yet opened applications and will announce acceptance after OMB approval.

Who it affects

  • Existing stablecoin issuers seeking OCC authorization may request temporary relief.

What is still open

  • The OCC must decide each waiver's scope and duration.
  • Other statutory requirements do not receive automatic relief.

What it means for an advisor

  • Obtain the issuer's actual waiver and application status before describing continued issuance as authorized.
  • Check the waiver's expiration and conditions.
